Separation is a stressful time for parents, their families and their children. At Austere Legal, we can guide you through the process by providing practical advice in all aspects of divorce.
We always advise our clients to seek legal advice as soon as a separation occurs to ensure that you understand your rights and responsibilities. We can provide advice on whether you meet the legal grounds for divorce, whether you are required to seek mediation or counselling services, and what your legal rights might be, should a divorce proceed.
Before filing your divorce application, the law requires the parties to have been separated for at least twelve months before filing for divorce. You do not have to be physically apart to be separated – you can still live under the same roof.
If you have been married for under two years from the date of marriage to the date of application, the court also requires mandatory counselling with a family counsellor to explore whether there is any prospect of reconciling.
We understand going to court can be stressful for you – that’s why we always consider options for you to avoid confronting your ex partner. Before going to court, we consider alternatives to litigation to ensure your divorce is finalised in a timely and cost effective manner.
