Before filing your divorce application, the law requires the parties to have been separated for at least twelve months before filing for divorce. You do not have to be physically apart to be separated – you can still live under the same roof.

If you have been married for under two years from the date of marriage to the date of application, the court also requires mandatory counselling with a family counsellor to explore whether there is any prospect of reconciling.
